To Bertrand de Cardilac, seneschal of the Limousin, Quercy and Perigord, Raymond de Bevill and Bertrand his brother, kinsmen of the king, have shown the king that Bernard de Bevill, their father, being of the king's fealty, lost by the late war with France his castle of Lymolye in the king's service, at the time that the king's brother Richard, king of Almain, held the king's place in those parts, as the said Richard and John de Plessetis, earl of Warwick, and others have testified before the king ; and the king, by the peace with France, has recovered the said castle; he therefore commands the said seneschal, if he finds by inquisition that this is so, to make restitution to them of the said castle, on condition that they hand it to the king when he lias need of it. But if any ambiguity arises in the said inquisition he is to send the inquisition to the king for him to do justice.

Safe conduct, for three weeks from the octaves of Easter, for Reynold de Pontibus and Margaret his wife and those of theirs whom they bring with them, in coming through the king's power to Bordeaux to sue their right before Edward, the king's son, or his seneschal of Gascony, on the day in the quinzaine of Easter which the king has appointed for them.

This letter was given to Bertram Kardilak in the presence of Sir R. Walerand Bertram de Bevil and Gaillard de Solio.

Notification that so long as the king shall hold the castle of Castelnau (de Castro Novo) on the Dordogne in the diocese of Perigueux, he is bound and promises to pay to Emery de Castro Novo and his heir 50 pounds of Tours yearly at the said castle. He is bound also to restore the said castle, whole or demolished, at the will of the king of France, when required by him to do so, and then the king shall not be bound to pay the said money. But the king cannot put the said castle out of his hand except in this way, and it shall be at the option of the king of France that it be restored, whole or demolished, when he wills.

Whereas by the late peace and composition between Louis, king of France and the king, Louis has given the king all the right which he had in the cities and dioceses of Perigueux, Limoges and Cahors, as in his letters patent to the king is more fully contained, the king has committed to Bertram de Kardilhac the castles, cities, boroughs, towns, and all other things pertaining to him in the said cities and dioceses, to keep during pleasure, commanding the prelates, chapters of churches, barons, knights, vassals and commonalities of the same to be intendant to him as the king's seneschal.

Grant to him of 1000 pounds of Tours yearly so long as he have the keeping. This letter was handed to Raymond de Sancto Bricio, knight, and fellow of the said Bertram.

Grant to him of 200 pounds of Tours yearly, because he has withdrawn from the homage and fealty of the king of France, with the licence of the latter obtained at the instance of the king, and has come to the king's homage and service.

This letter was handed to the prior of Le Mas to be handed to the said Bertram when there should be need.

To the prelates, chapters of churches, barons, knights, vassals and commonalties of the towns and all others of the cities and dioceses of Perigueux, Limoges and Cahors. Whereas it is provided in the peace between the king of France and the king that they and their successors shall do their fealties and other rights which they do to the king of France, henceforth to the king, and the king, relying upon their goodness hopes that they will, at his prayer, do this willingly, and begs them to fulfil the mandates of the king of France when presented by the bearer, and to be assured that they will find justice in the king, the tide of peace and the conservation of their rights and liberties. And that these things may be more easily fulfilled, the king has appointed Bertrand de Kardylak, their neighbour, and having knowledge of their estates and the conditions of their lands, as his seneschal, during pleasure, as they will see in other letters, to whom they will answer touching their faculties and other rights of the king in the king's place and name as to the king himself; and the fealties which they so do, and their rights which they so render, the king will regard as done and rendered to himself. And if perchance any shall not regard himself as bound to do these things by the letters of the king of France and his predecessors, let them reflect that the more liberal they are to the king in this behalf, the more strongly and sweetly (dulcius) they will bind the king to them, although the king of France ought to compensate the king for those, if there are any, who wish to insist upon their privileges; but those whose predecessors laudably served the king's predecessors, it would be much more to his taste [to have] than others, even though equal to them or even more powerful. This letter was handed to Raymond de Sancto Bricio, knight and fellow of the said Bertrand.

Request to the constable of the castle of Limeuil (Limolio) which Louis, king of the French, has demised to the king to hold according to the terms of the peace between them, to deliver the castle to Bertrand de Kardilak to whom the king has committed the keeping of the lands and castles in those parts.

Whereas Edward the king's son has appointed a day to Reynold de Pontibus and Margaret his wife on the quinzaine of Easter at Bordeaux to have justice in a cause which they are moving before him touching the affair of Brugerac, the king, lest the said Edward should be negligent or remiss in this matter, and such negligence prejudice the king by reason of the cause being on that account taken to the trial (examen) of the king of France, the king empowers the bishop of Bazas, Bertram de Cardilak and William Reymundi Columb to take cognizance of the said cause, if necessary, and do justice in the king's place to the said Reynold and Margaret on a day which the said bishop, Bertram and William shall appoint.

Appointment of them

Notification to the said Louis of the appointment of Nicholas de la Leye, king's clerk, to sue and have again the king's court of Gascony upon the question or petition which Reynold de Pontibus and Margaret de Thoran, his wife, are making to the king touching the castle and land of Brigerac.

In the same form and words issued another letter under the name of Master S. de Vercellis.

Afterwards there was joined with them William le Latymer in the said form and they had four pairs of letters.

Whereas the king at Paris, in December 1259, by word of mouth charged Drew de Barentin, seneschal of Gascony, to do justice to Reynold de Pontibus and Margaret his wife in the question they have moved against the king in the affair of Bergerac, he has now enjoined on Edward his son, who has held Gascony for the last seven years, to do them justice and not fail.

Appointment of William de Trublevill, king's knight, and Master Walter Giffard, as proctors before Louis, king of France, at Paris a week after Candlemas to shew cause why the king should not receive the said Reynold as his man of the land of Gensac.

The like of the same as proctors to sue and hold the court of Gascony upon the question or petition which the said Reynold makes to the king touching the taking of his homage for the land of Gensac in the present court or parliament of Louis, king of France, on the octaves of the Purification and following days.

The like of Master Walter Giffard and Ralph de Dungun, king's clerks, as proctors in the causes between the king and the said Reynold and Margaret, in the said court or parliament. Ita sane quod quantum ad hoc non sit melior condicio occupantis.

The like of the same in the same terms, ita sane &c.; ratifying whatever they did in this matter in the other parliament of the said Louis after Martinmas last upon the affair of Brigerac.

Three other letters procuratorial are made by the same words, without expression of the names of the proctors, whose names ought to be inserted in them at Paris by counsel of Edward the king's son and Master Simon de Vercellis, if it shall be necessary for default of other proctors ; and these and others directed to Edward and Master Simon and the other proctors were handed to Robert de la Bare and his fellow to be taken to France with the roll of the process had in France.

To Edward the king's son. The king understands by letters of Master Simon de Vercellis as by the relation of others that on account of the default and omission of Edward's seneschal of Gascony and other deputies for holding the court of Gascony on the quinzaine of Easter last touching the affair of Brigerac, grave damage and danger threaten the king and the said Edward in the court of France, and nevertheless the proctors of the king and the said Edward in the last parliament of the court of France imprudently proceeded in this matter beyond the counsel and assent of the said Simon, whereby it is very expedient that for the reformation of the said processes, the said Edward should apply some efficacious counsel and especially…/ use the counsel of the said Master Simon, who is fully acquainted with the changes (alteraciones) on both sides. The king has also appointed Master Walter Giffard and Ralph de Dungon, clerk of the said Edward, as his proctors in all matters between the king and Reynold de Pontibus and Margaret his wife for the day fixed for himself and the said Edward in the court of France on the octaves of the Purification. To this the king is cited to shew why he has not received the homage of the said Reynold of the land of Gensac, which by judgement of the court of Gascony when the king was there last, he retained, as the said Edward knows. And as the king does not intend that for default of right this question should be ventilated in the court of Fance, he has put William de Trublevil and Master Walter Giffard in his place to give the reason in the said court why he ought not to receive the said homage, and to seek the court of Gascony if they think fit He therefore commands the said Edward to assist the said proctors, and to give them such aid and counsel that the right of the king and himself may be saved. As a further precaution the king sends other letters procuratorial with the names of the proctors left blank, so that if any of the said proctors is prevented, another may be substituted by the counsel of the said Edward and Master Simon.

Whereas by the form of the peace with the king of the French, the king has received the castle of Limeuil (de Limolio) which Bernard de Bevile, being of the king's allegiance in the war with the said king, lost in the king's service at the time that Richard, king of Almain, the king's brother, was the king's lieutenant in the parts of Perigueux, as the said Richard and John de Plessetis, earl of Warwick, and others have testified before the king; the king has restored it to Raymond de Bevile and his brothers, sons of the said Bernard, saving the right of the king and his heirs, to hold in the same manner as the king held it while it was in his hands, and with the same liberties and free customs as Bernard and his ancestors held it; on condition that he deliver it to the king and his heirs when they have need of it.

Whereas the king restored to his kinsman Raymond de Beivil and his brothers the castle of Limeuil as their right and inheritance and certain of their men and tenants withdrew themselves from their lordship and power, whereby they are defrauded of their services and rents, the king grants that these, whereever they may be in his power, may return without hindrance to their dominion and power, and commands all persons of the dioceses of Limoges, Cahors and Perigueux not to receive the tenants of the said brothers against their will, but to cause them to return to the lordship and power of the said brothers.

Mandate to the prior of St. James, Bordeaux, to collect the arrears in Gascony of bequests in aid of the Holy Land, of the money of Crusaders and indistinctly bequeathed ; which amount to 1000 marks, and belong to the king by grant of the pope ; and thereof to pay to William de Talyva 300 marks in part payment of what the king owes to him, and to keep the residue until further order.

The like mandate to him by letter close.

Archdeacon of Stafford, Simon de Brideport, archdeacon of Dorset, Richard de Malmesbiry, archdeacon of Meath, Godfrey Giffard, John de Pontesio, Ralph de Bohun, William de Percy and Master Thomas de Piwelesdon, king’s clerk, as the king’s proctors in the cause which Reynold de Pontibus and Margaret his wife are bringing in his court against the king touching the affair of Brigerac on the day fixed, to wife three weeks after the Purification and following…/ days, with power to swear on the king's soul, and to speak the truth, and to put themselves on a jury and answer (et ad ponendum et respondendum) and do other things in the said cause.

A like letter issued by the name words except the words ‘and to speak the truth,’ and another except the words ‘et ad ponendum et respondendum,’ and the said three pairs of letters are of the said form and date.

Notification that the king never despoiled Reynold de Pontibus Margaret his wife of the castle of Bergerac, and never demanded that it should be despoiled by any of his adherents ; and power to the above Masters Simon and Richard, Godfrey, Ralph, William and Thomas to swear if necessary to this on the king's soul.

Notification to the king of France of the appointment of the said Master Hugh and others as the king's proctors to state the reason why he ought not to receive the said Reynold of the land of Gensac as his man, or be made to receive his fealty for the said land by any of the king's men in Gascony according to the form of Louis' mandate directed to the king ; and to do other things in the premisses which the order of right may require, on the day appointed, to wit, three weeks after the Purification.

The like of the same to say or propose against the said Reynold and his wife in the matter of Gensac whatever may be to the advantage of the king and his jurisdiction in Gascony.

Whereas Reynold de Pontibus and Margaret his wife, by Louis, king of France, sued for the king to be compelled to receive the homage and fealty of the said Reynold in the name of his wife for the land and castle of Gensac, and the king answered in the court of France that he was ready to show justice to the said Reynold and Marga et and also to Ridel de Brigeriaco, who opposes this asserting that lie has some right in the said land and castle and suing for his homage to be received by the king and for him to be seized thereof, before the said Reynold and Margaret moved any cause (questionem) against the king in the court of the king of France, and to any other persons interested herein ; and whereas the said court of France decreed (disposuerit) that the king should fix a day and place for the said Reynold and Margaret in his court of Gascony, to proceed in the premises according to law and the custom of those parts, and signify such day to the said provost, that lie may certify the said Reynold and Margaret thereof; the king fixes a day, one month after Easter at Bordeaux, to proceed in the premises and lias given a snfe conduct to the said Reynold and Margaret, their goods and the persons whom they bring with them.

Grant to the consuls and university of the royal castle of the diocese of Perigueux on the Dordogne of such customs, liberties and immunities as Raymond, sometime count of Toulouse, or Alfonse, now count of Toulouse and Poitiers, the king's kinsman, gave to the consuls and commonalty or inhabitants of any of the bastides which he caused to be made, so that it be at their option to choose any of these they will; and full power to John de la Lynde to grant the same to them.

Commission to the bishop of Bazas, Amanieu de la Breto, Peter de Burdegala and John de la Lynde, seneschal of the Limousin, Perigord and Quercy, in amplification of their former commission to hear and determine the question (questionem) twitch Reynold de Pontibus and Margaret his wife have moved against the king in the court of France, wherein they sue that they be admitted to the king's homage and fealty for the castle of Gensac, and for which the king has fixed for them a day at Bordeaux a month after Easter upon which to show them justice according to the courts and customs of the court of Gascony ; and lest, through any default of court, they or any others claiming any right in the said castle or moving any question, should have recourse to the king ; to hear and determine all such questions, and to appoint, if need be, a court of the barons of Gascony ; and to continue the proceedings, if necessary, for further days and in other places.

Notification to the king of France that that king approves and ratifies what his proctors did in the parliament at Paris three weeks after the Purification in the causes moved against the king by the said Reynold and Margaret touching the castles of Bergerac and Gensac.

Whereas in the cause which the said Reynold and Margaret move against the king in the court of the king of France in which they say they were despoiled by the king, in the possession of the castle of Bergerac, certain proctors, appointed by the king in the past year, exceeded their powers without the king's knowledge, upon the third article, the king repudiates their action.

Notification to the king of France of the appointment of the above proctors in almost identical terms.

A covenant made between the king and Raymond, vicomte of Turenne, The said Raymond, at the prayers of the king of France, shall renounce the letters and privileges which he has of the said king and his predecessors, containing that the king of France cannot put him out of his hand (extra manum suam). He and his heirs and successors shall do fealty and homage to the king and his heirs for the castles, land and fees which he holds of the kins of France, which are of the vicomté of Turenne, and also for his money (moneta) and the right of coining it, and shall hold all these things of the king and his heirs in the same way as he or his ancestors held of the king of France, and shall do to the king what he and his predecessors were accustomed to do to the king of France. He and his heirs, in sign of lordship, shall surrender the keys of the castles of Turenne and St. Cere (de Sancto Sereno) to the king, and two or three men of the king shall enter and go up with the king's banner into the said castles without excluding the household and people of the vicomte and shall there display the said banner. And this surrender of keys, entry, going up of the said men with banner, and display of the said banner shall be done once in the king's time, and in like manner once in the time of each of the king's heirs, when the vicomte is required by such heir. And immediately after this has been done the said keys shall be restored to the vicomte a,nd the said men with the banner shall retire from the said castles.

The king shall not have cognizance of the causes and litigations (litigiis) of the men of the vicomte who are of his court (ford) and jurisdiction, unless the same are brought to the king or his people or his court by appeals from sentences in the vicomte's court, and unless the vicomte in doing justice shall bo negligent or in default.

The king, or his seneschal at his mandate, shall not make any new bastides within the bounds of the land which the vicomte has in the vicomte of Turenne, nor in any other land of the vicomte.

The vicomte can with arms (without being bound to make any amends for this) or without arms, compel the men of his court and jurisdiction, if need be, to stand and obey law in his court.

The king or his seneschal shall not hold assizes in the castles of the vicomte or in any other land of his except in the town of Martell, but there the vicomte is willing that he hold them.

The king shall aid, defend and maintain the vicomte against all men refusing to receive justice from him before the king or at his mandate.

For the fuller observance hereof, each party has made letters patent to the other.

A like covenant with Poncius de Gordonio. [This contains the same clauses as the enrolment below dated 22 April, printed in Foedera, except the last three touching Gilbert de Tamynes, the not putting the said Poncius out of the king's hand, and the seneschal's oath.]

A like covenant with Gaillard, abbot of Figeac and his monastery.

He shall renounce the letters and privileges which he has of the king of Prance, and do homage and fealty to the king for the things and fees of his monastery.

The king promises to give him like letters and privileges, or better than he had of the said king of France.

The king will give him letters that he and his successors cannot put him out of his hand.

The king will keep and defend the rights and liberties of the said monastery as is contained in the letters and privileges of the kings of France, and if in past time anything has been attempted by the kings of France against the said monastery, it shall not be drawn into a precedent. The king will renew the privileges which they have of the kings of France, and touching a privilege of a certain king of France called Louis, the king will stand by it and will give credence to a copy thereof sealed with authentic seals.

If any persons of the district and jurisdiction of the said abbot have up to this present day committed any offence, or done any forfeiture, and if through negligence or default of the abbot or his predecessors, any causes in the town of Figeac or other land and fee of the abbot have come to the court of the king of France, or if the king of France ought to receive anv amends in the town, land and fee of the abbot up to the present, the king grants that from the time the abbot shall have done his homage and fealty to the king, he shall have his court of the said trespasses, and he and his men of his district and jurisdiction shall be quit of the said amends, saving this, that, as regards future causes no prejudice shall arise to the king or his heirs.

The king will protect, maintain and defend the abbot and all those who have procured his coming to the king's fealty against all men and will grant him letters patent of protection accordingly.

For the fuller observance hereof, each party has made letters patent to the other.

Bond to the abbot of Figeac in 1,000 pounds of Tours, to be paid at the place and term agreed between the abbot and Raymond de Bovis Villa, king's kinsman, and John de la Lynde, seneschal of the Limousin, Perigord and Quercy.

Notification to L. king of France of the appointment of Raymond de Bovis Villa, king's kinsman, and Simon Passelewe and Master John de Pontesio, king's clerks, as proctors in the cause which the king has against Reynold de Pontibus and Margaret his wife in the court of the king of France touching the castle of Bergerac ; with power to depose (ponendi) and to answer by oath on the king's soul, and of suing and exacting that the king's witnesses and proofs touching his defences and especially touching his answering the truth upon oath, be admitted before the said king, lest to the peril of the king's soul, the subversion and shame of his royal eminence, honour and right which as a peer of France he has in the said court, he be convicted of perjury through the non-admission of his proofs upon his defences : and to sue, if need be, for judgment of the king's peers, as this question touches not only the king's body but his soul, estato and honour, and to protest that mortal sin is being committted against the king, if his proofs be not admitted in his defences in the said question : and to do and protest all other things that are to be done and to do this on the day appointed on the quinzaine of the Purification and following days if the case continues. And this is signified both to the king of France and the adverse party.

To the said L. king of France, repudiating the action of the king's late proctors in the affair of Bergerac in the same terms as above.

Grant for life to Raymond, vicomte of Turenne, of 195 pounds of London. Tours a year at the Purification by the hands of the seneschal of the Limousin, Perigord and Quercy from the ' commune ' of Perigord (de commune Petragor') or other issues of the king's lands in those parts, if the said ' comune ' fail for any reason; on condition that he may be able by justice to recall knights' fees alienated in mortmain or in the hand of burgesses and that in this he be aided by the seneschal if he require him. Likewise, if anyone without the king's power attack him with arms, he may defend himself and his lands with arms, and if necessary attack, provided that no prejudice arise hereby to the king or his seneschal, to prevent their doing justice to those who complain of him. Further, if the king by pretext of the peace with the king of France, can sue anything which the king of France could sue as due for the keeping of castles or expenses for them or by reason of offence committed by him of the time that the vicomte held his land of the king of France, the king will not sue it of the vicomte.

Grant to Guy de Turenna, clerk, brother of Raymond vicomte of Turenne, of 150 pounds of Tours payable at the Purification, during pleasure, from the ' commune ' of Perigord, or the other issues of the king's lands in the dioceses of Limoges, Perigueux and Cahors by the hands of the seneschal of those parts if the said ' commune ' should fail.

Grant for life to Peter Aurioli, donzel, of 15 pounds of Tours a year from the same.

The like to Poncius de Gordonio of 100 pounds of Tours a year from the same.

Notification to Louis, king of France, of the appointment of Simon Passelewe, Aubert le Provost and Master John de Pontesio as the king's proctors in the cause which Reynold de Pontibus and Margaret his wife have against the kimr in the court of the king of France, touching the castle of Bergerac, in the instant parliament of the octaves of Whitsunday; with power to swear on the king's soul any kind of oath, and to do all other things which lawful proctors can do. Nevertheless the king ratifies whatever is done for him in the whole parliament of the king of France after the quinzaine of the Purification by his clerks Raymond de Bovisvilla, his kinsman, and the said Simon and Master John, his proctors sent in the above cause ; and this is notified to the said king and to the adverse party.

Notification to the said Louis that, in the above cause, the king ratifies whatever his proctors, the above Raymond, Simon and Master John did on the quinzaine of the Purification and subsequent days, when the said Reynold and Margaret produced witnesses, in protesting in the king's name against the persons and evidence of the said witnesses and in their other arguments, defences and exceptions.

Whereas the king and P. archbishop of Bordeaux each assert that the castles of Bigarroque (Brigaroca), Belves (de Bello Videre), Millac (de Milliaco), Couse (de Gosa), la Mothe Montravel (de Monte Revelli), the mota of St. Paixent (de. mota Sancti Paxencii), with their boroughs, manors, and appurtenances, are his ; and the king gave power to P. bishop of Perigueux, William, prior of Le Mas d'Agenais, that after the archbishop shall have obtained corporal possession of them, they shall hear plainly and without the din of judgement (sine strepitu judicii) the arguments of both parties and receive the instruments and witnesses if the king thinks fit to produce any, and the propositions on both sides, and adjudge and assign the said castles to whichever party they ought to be assigned ; and whereas it has been agreed between them that if the said bishop, whom the archbishop appointed for this business, cannot or will not attend to it, the archbishop may substitute another in his place, and the king in like manner) may appoint another in the place of the said prior and the said prior cannot attend ; the king has substituted in his place Raymond, vicomte of Turenne.

Whereas Louis, king of France, by letters lately required that the king would cause the new castle on the Dordogne (Castillon sur Dordogne), in the diocese of Perigueux, to be delivered to Heymericus de Castro Novo or his heir, but destroyed, saving the church in the castle; the king has given back the castle, on condition that it be first wholly destroyed, saving the church in the castle which the king wishes to remain untouched.

Mandate to Imbert Gy, seneschal of Perigord, to cause this to be done. But for the arrears of one year wherein they say the king is bound to them for the said castle, the king wills that if after having heard their reasonings, he shall find by lawful judgment between them that the king is so bound, he shall pay the said arrears without delay, and recover the bond which the king made to them of the said money, and keep it with him, cancelled, to be delivered to the king in due course.

Promise to the said citizens that, whereas they are bound to acquit the king towards the king of France to the value of 30,000 pounds of Tours in sterlings and they have a certain part thereof in halfpennies, if they incur any loss in the exchange or loan of such halfpennies, the king will make it good to them or cause the amount to be allowed to them in other moneys which they owe to him.

Mandate to Simon Passelewe that if the king of France will not receive the penalty of 10,000 pounds of Tours of the 20,000 pounds of Tours, …/

To Louis, king of France. Whereas Queen Eleanor and Edmund the king's son for the king's urgent need in their own names sold to the said Louis and his heirs for 20.000 pounds of Tours, which they received, whatever of right or lordship the king had by grant made to him by the composition and peace entered into between Louis and the king, in the cities and dioceses of Limoges, Cahors and Perigueux ; and all that which Louis is bound to compensate the king with in the said cities and dioceses for those things, persons or lands and other things which Louis cannot put out of his hands, according to the form of the said peace ; and whatever of right or lordship the said queen and Edmund had therein or could come to the king or them : and whereas the said queen and Edmund promised and bound themselves to Louis to procure the king's ratification of the sales and if they did not procure this, they would restore the said 20,000 pounds of Tours and would also with this give 10,000 pounds of Tours in the name of a penalty; and the king did not ratify the said sale but has paid the said 20,000 pounds of Tours and is bound to send the said 10,000 pounds within a fortnight or three weeks of Whitsunday; the king requests the said Louis to cause the said land to be delivered to such person as the king is sending for this; and the king promises and binds himself to pay the said 10,000 pounds of Tours at the Temple within the said term of Whitsunday.
